Service Terms & Conditions
1. I am at least eighteen years of age or have parental or guardian
permission to access JTNET Internet services.
2. JTNET Internet Services exercises no control whatsoever over the
content of the information passing through JTNET servers. However, JTNET
Internet Services reserves the right to restrict any content hosted on
JTNET servers by private users, commercial accounts, virtual servers and
virtual providers. JTNET reserves the right to restrict or limit service
to anyone for any reason. All content placed on JTNET servers is subject
to review and may be removed, if the material is not suitable for viewing
by persons of all ages. Customers who have co-located equipment must make
known what that equipment is doing. JTNET reserves the right to terminate
co-location agreements or to turn down co-location customers if the Service
performed on those machines violates JTNET's terms and conditions.
3. JTNET Internet Services makes no warranties of any kind, whether
expressed or implied, for the Service it is providing. Certain Internet
services may contain language or pictures which some individuals may find
offensive, inflammatory, or of an adult nature. Viewing such contents is
the sole responsibility of the subscriber. We do not endorse such materials
and disclaim any and all liability for their contents. JTNET also disclaims
any warranty of merchantability or fitness for a particular purpose. JTNET
will not be responsible for any damage you suffer. This includes loss of
data resulting from delays, nondeliveries, misdeliveries, or service
interruptions caused by its own negligence or your errors or omissions. Use
of any information obtained via JTNET is at your own risk. JTNET Internet
Services specifically denies any responsibility for the accuracy or quality
of information obtained through its services.
4. JTNET Internet Services may only be used for lawful purposes.
Use of JTNET Internet Services for lawful commercial purposes is both
permitted and encouraged. Transmission of any material in violation of any
US or state regulation is strictly prohibited. This includes, but is not
limited to: copyrighted material, material legally judged to be threatening
or obscene, or material protected by trade secret. You agree to indemnify
and hold harmless Onesimus Enterprises International, Inc. from any claims resulting from your use of the Service,
which damages you or another party. Access to any network must comply with
the rules appropriate for that network. Violations of this policy include,
but not limited to, attempted unauthorized access and denial of service
attacks. JTNET specifically prohibits users from mass distribution of
unsolicited materials (commonly known as SPAMming). Any one found SPAMming
from JTNET servers will have their service immediately turned off with
possible legal prosecution and administrative fines. We will contact the
appropriate authorities of any illegal activity.
5. Service is generally available daily, seven days a week, 24
hours a day, except for maintenance. Service maintenance generally takes
place from 3 a.m. until 7 a.m. Eastern Time on Saturday and Sunday. However,
JTNET may at anytime, without notice or liability restrict the use of the
Services or limit its time of availability in order to perform maintenance
activities.
6. Payment for all JTNET Internet Services is due in advance of
delivery. Prices are for delivery FOB Staten Island, New York.
JTNET Internet Services is billed under our parent company,
Onesimus Enterprises International, Inc.; and charges to your credit card will reflect this name. Onesimus Enterprises International, Inc.
reserves the right to change the rates and otherwise modify these
Terms and Conditions at any time and without notice. All dial-up and
ISDN accounts will be invoiced electronically via the master JTNET
subscriber's Internet e-mail. JTNET Internet Services does not invoice
dial up and ISDN accounts either by the US Post Office mail. It is the
obligation of the subscriber to inform JTNET of any credit card on file
that needs to be changed, deleted, updated, or change of expiration date.
Any account that cannot be charged on the due date to the credit card
assigned to that account will be deactivated (re-activation will result in
a charagable service fee).
7. We reserve the right to immediately withdraw the Service from
you if, in our opinion, your use of the Service is disruptive, causes a
malfunction of the Service, violates the terms of this Agreement or if we
receive information that the Service or your use of the Service (or any
part thereof) may violate any copyrights or other intellectual property
rights of ours or of any third party. These Terms and Conditions supersede
all previous representations, understandings or agreements and shall
prevail notwithstanding any variance with terms and conditions of any
order submitted. Use of JTNET constitutes acceptance of these Terms and
Conditions, that you have read the above terms and conditions for use of
JTNET, that you agree that you are bound by its terms and that it is the
only agreement between us regarding JTNET Internet Services (and
Onesimus Enterprises International, Inc.).
8. Unlimited Use Policy: Unlimited accounts are the not the same
as dedicated accounts. Unlimited use means that you are using your account
while connected to our modem banks. Pinging, auto e-mailing, boting, etc.
are not allowed in order to keep your connection while not in attendance on
your computer. All dial-up accounts are subject to a 10-minute idle timeout
and an 8-hour session limit. However, reconnecting thereafter is permitted.
DSL accounts are not subjected to these timeouts and limits. However,
Residential DSL accounts are subject to dynamic IP address changes.
Payment and Late Payment Policies
1. Unless otherwise specifically noted, service or products from JTNET
Internet Services are paid in advance of services and or products.
2. DUE DATE means:
A. first day service began
B. date product and/or service was purchased
C. reoccurring date for billing - (quarterly, semi-annual, or annual)
3. Payment for JTNET Internet Services and products can be paid with:
A. MasterCard, Visa American Express, and Discover Card (preferred)
B. Company Checks
C. Money Order
NOTE: All credit card charges are handled by our parent company,
Onesimus Enterprises International, Inc.
4. JTNET Internet Services' billing system will automatically disable
dial-up and ISDN accounts that are 5 days late. All past due
amounts must be brought current before account is turned on (a chargable
re-activation fee may apply).
5. Web Site customers will be billed on the fifth day of the
month. Any Web Site customers that have not paid within 20 days are
delinquent. When a Web Site becomes delinquent it will be disabled the
following day. To re-enable a Web Site, a $50.00 service fee will be
charged. All past due amounts must be brought current before a Web Site
is turned on.
6. Dedicated Accounts (Frame Relay, xDSL, Point-to-Point, etc.)
will be invoiced on the fifth day of the month. Any dedicated accounts
that have not been paid within 20 days will be delinquent. Dedicated
accounts will be turned off the first day after they become delinquent.
A re-activation fee of $150.00 will be charged to turn on a dedicated
account. All past due amounts must be brought current before account
is turned on.
7. Telco connections will be invoiced by the carriers to the
customer and is the customer's responsibility.
8. Returned Company Checks will be charged a $35.00 returned check
fee. If a second occurrence appears on the same account, that company may
no longer write checks for payment. The account will be referred to
automatic credit card withdrawal.
